+1 for #1 likewise.

For a while, we even required 1.3, I think (Collections.EMPTY_MAP) but
kludged back to supporting 1.2 by providing our own EMPTY_MAPesque thing.

I wouldn't even know where to start to make jaxen 1.1able.
